Terms of Service

The Service is provided by Go Indigo, LLC, a Colorado limited liability company based in Douglas County, Colorado, United States. You can reach us at support@goindigo.io.

You must be at least 18 years old and able to enter into a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. You are responsible for keeping your account credentials confidential and for all activity under your account, and you agree to provide accurate information and keep it up to date.

Indigo helps you organize tasks, notes, records, persons, and documents, and connects to Google Calendar and Google Drive. We may add, remove, or change features at any time. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

You agree not to:

• use the Service in violation of any law or third-party rights;
• upload, send, or store content that is unlawful, infringing, defamatory, harmful, or harassing;
• send spam, phishing, or fraudulent messages;
• introduce malware or attempt to interfere with the security or integrity of the Service;
• probe, scan, scrape, or test the vulnerability of the Service;
• reverse engineer, decompile, or attempt to extract the source code of the Service except where applicable law expressly permits;
• resell, sublicense, or otherwise commercialize the Service without our written consent.

You retain ownership of the content you create, upload, or connect to the Service ("Your Content"). You grant Go Indigo a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, and process Your Content solely as necessary to provide the Service to you. You are responsible for Your Content and for ensuring you have the rights to use it.

Go Indigo seeks to avoid deleting any information from your Google account. However, with any integration there is a possibility of errors, and records may be deleted, modified, or duplicated by mistake. You are responsible for maintaining your own backups of important Google Calendar, Google Drive, and other data, and you acknowledge that Go Indigo is not liable for any loss of data resulting from integration errors, sync conflicts, or other technical issues to the maximum extent permitted by law.

The Service, including all software, design, branding, and documentation, is owned by Go Indigo and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. No other rights are granted by implication.

Indigo is offered as a paid subscription at the prices shown on our pricing page. Payment processing, billing, tax calculation, currency conversion, invoicing, and renewals are handled by Paddle.com, our Merchant of Record. By subscribing, you also agree to the Paddle Checkout Buyer Terms.

Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel. You can cancel at any time at paddle.net or by contacting support; cancellation takes effect at the end of the current billing period and your access continues until then.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

We offer a 60-day money-back guarantee. If you are not satisfied with your purchase, you may request a full refund within 60 days of your initial order date. Refunds are processed by Paddle. To request a refund, visit paddle.net or email support@goindigo.io.

Go Indigo may suspend, cancel, or terminate your subscription or account at any time, for any reason, with or without notice, including for breach of these Terms, non-payment, suspected fraud or abuse, legal or regulatory reasons, or at our sole discretion. If we terminate your subscription without cause, we will refund any prepaid, unused portion of your then-current billing period. We are not obligated to refund amounts already paid in cases of termination for breach of these Terms, fraud, or abuse.

On termination, your right to use the Service ends immediately. We will give you a reasonable window to export Your Content where feasible, after which we may delete it from our systems consistent with our Privacy Policy and applicable law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, GO INDIGO DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO INDIGO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

You agree to defend, indemnify, and hold harmless Go Indigo and its officers, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) Your Content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your violation of any third-party rights.

We may modify the Service or these Terms at any time. If we make material changes to these Terms, we will notify you by email or via an in-app notice before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws principles. You and Go Indigo agree to the exclusive jurisdiction of the state and federal courts located in Douglas County, Colorado for any dispute arising out of or relating to these Terms or the Service, except where prohibited by applicable law.

You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and Go Indigo regarding the Service.
